  • In Michigan, a dog's owner is liable for a bite without provocation to someone on public property or lawfully on private property, "regardless of the former viciousness of the dog or the owner's knowledge of such viciousness" (MCL 287.351).
  • Under the statute, provocation is the only defense the model jury instructions list, and comparative fault doesn't reduce the award (M Civ JI ch. 80; Hill v Sacka, 2003); a government owner, such as a police department, may be immune (Tate v City of Grand Rapids, 2003). Even an unintentional act can be provocation if it would reasonably be expected to make a dog react as it did (M Civ JI 80.03; Brans v Extrom, 2005).
  • Most injury lawsuits must be filed within three years (MCL 600.5805(2)). Someone bitten as a child has until at least a year after turning 18 (MCL 600.5851(1)), but a parent's own claim for the child's medical bills doesn't get that extra time (Walter v City of Flint, 1972).
