- A Michigan malpractice lawsuit generally must be filed within two years of the mistake, or six months after you discovered or should have discovered the claim if that's later, and generally no more than six years after the mistake (MCL 600.5805(8), 600.5838a).
- Before suing, you generally must mail each provider a notice of intent at least 182 days ahead (MCL 600.2912b), and the lawsuit must be filed with an affidavit of merit from a health professional who meets Michigan's expert rules (MCL 600.2912d, 600.2169).
- For 2026, noneconomic damages such as pain and suffering are capped at $596,400, or $1,065,000 for three kinds of permanent injury the statute lists (MCL 600.1483; Michigan Department of Treasury, January 30, 2026).
